Terms & Conditions

Same legal structure as the current terms, updated where the new model changes things: free monthly credits, the £14.99 unlimited subscription, and AI marking. Sections marked Updated carry the changes; amber boxes flag spots that need a lawyer or a decision before they become wording.

1Introduction

By accessing and using examsolutions.net and app.examsolutions.net (“the Site”), you agree to these Terms and Conditions. If you do not agree, please discontinue use immediately.

2Company Information

ExamSolutions is owned by Visely Limited (Company No. 11992575), registered at 123 Uxbridge Road, Uxbridge, England, UB10 0LQ.

3Services OfferedUpdated

Free tier. All video lessons and worked-question videos are free, without an account. A free account also includes 5 credits per interactive feature per month – practice questions, guided courses, uploaded-paper markings and built-paper markings each have their own allowance. Your remaining credits are always shown before a credit is used. Unused credits do not roll over to the next month.

Unlimited subscription. A rolling monthly subscription at £14.99 per month removes the credit meters across every interactive feature. You can cancel at any time from your account settings; access continues until the end of the paid billing period.

AI marking. Axi, our AI tutor, provides automated marking and feedback. AI marking is provided as study guidance – see Section 4.

Decision needed – money-back guaranteeThe current terms tie a money-back guarantee to the Boost+ plan (“complete 80% of the course”). The settled model has a single £14.99 plan. Whether the guarantee carries over, changes shape, or retires is Michael’s call – then a lawyer should word it. Left out of the draft above on purpose.
Needs legal review – credit wording“Credits do not roll over” and the per-feature allowance are new contractual wording. A lawyer should confirm phrasing, and whether credits need a “no cash value” line.

4Use of ResourcesUpdated

  • Tutoring services: we act as an agency connecting students with tutors. Lessons cancelled by the client with less than 24 hours’ notice may still be charged.
  • Resources are checked for accuracy but should not replace guidance from qualified professionals.
  • AI marking (Axi) is produced against mark-scheme guidance and shown step by step so it can be checked. It is study guidance, not a guarantee of the marks an exam board would award.
  • ExamSolutions is not liable for exam results, academic performance, or progression, regardless of payment.
  • Downloadable resources come with previews; therefore, refunds are not provided.
Needs legal review – AI marking disclaimerThe AI-marking bullet is new. A lawyer should check it covers predicted grades and teacher-assessed work, and that it sits consistently with Section 9 (Liability).

5Intellectual Property & Redistribution

  • All resources, whether free or purchased, are for personal use only.
  • Hosting, redistributing, or sharing resources on social media, websites, or other platforms is strictly prohibited and may result in legal action.
  • Linking to resources is permitted, but direct hosting is not.

6Refund PolicyUpdated

Refunds are only available for defective physical goods, where applicable, and are not offered for downloadable content or for unused free credits. The refund process requires proof of purchase, and refunds may take several days to process.

Cancelling the unlimited subscription stops future payments; it does not refund the current billing period, during which access continues.

Needs legal review – subscription refundsThe cancellation line reflects standard UK subscription practice, but statutory cooling-off rights (Consumer Contracts Regulations) may give new subscribers a 14-day cancellation right. A lawyer should confirm the exact wording before this ships.

7User ConductUpdated

Users must:

  • Provide accurate information when using the Site.
  • Refrain from unauthorized use of accounts, redistribution of resources, or engaging in harmful or fraudulent activity.
  • Not create multiple accounts or use automation to bypass free-credit limits.
  • Not upload malicious software, spyware, or other harmful content to the Site.

Violations may result in account termination and legal action.

8Privacy & Security

We take reasonable measures to ensure the Site’s security. However, ExamSolutions cannot guarantee uninterrupted service or that the Site will be free from viruses or other harmful elements.

9Liability

ExamSolutions is not liable for indirect or consequential losses, including missed academic targets or financial loss arising from use of the Site. This limitation does not exclude liability for fraud or negligence resulting in death or injury.

10Amendments

ExamSolutions reserves the right to update these Terms and Conditions. Material changes to pricing or the credit model will be notified to account holders by email before they take effect. Users are encouraged to review the terms periodically.

Needs legal review – change notificationThe current terms allow updates “without prior notice”. The added email-notification commitment is proposed wording – a lawyer should confirm what notice period UK consumer law expects for subscription changes.

11Governing Law

These Terms and Conditions are governed by English law, and disputes are subject to the exclusive jurisdiction of the English courts.
